Webster, Mrak and Blumberg, by Mark E. Brennan, Attorney at Law, appeared on behalf of the petitioner.

Menke and Jackson, by Anthony F. Menke, Attorney at Law, appeared on behalf of the employer.

MacDonald, Hoague and Bayless, by Harold H. Green, Attorney at Law, appeared on behalf of the incumbent, Washington State Nurses Association.

On May 21, 1990, an order was issued in the above-entitled matter, directing an election.[1] Issues concerning the bargaining unit status and voter eligibility of certain employees were reserved for post-election determination. An election was conducted by the Commission on May 31, 1990, at which time a majority of those eligible cast ballots for United Staff Nurses Union, Local 141. No objections were filed, and a certification was issued on June 8, 1990.[2] It has subsequently come to the attention of the Executive Director that the certification was in error by its failure to be designated as an "interim" certification, and that the parties are entitled to further proceedings to resolve the eligibility issues reserved in the order directing the election.

NOW, THEREFORE, it is

ORDERED

1.                  The certification issued on June 8, 1990, as Decision 3491-A - PECB, is hereby re-designated as an "interim" certification.

2.                  The case is remanded to Hearing Officer J. Martin Smith for further proceedings on the eligibility issues reserved in the matter, consistent with Decision 3491 - PECB.
